Demarest e Almeida was the first Brazilian law firm to create an area specialized in Corporate Criminal Law and corruption prevention in companies, in 1995. Our daily practice has been steadily increasing over the years, with our attorneys defending corporations and their agents, or fighting corporate frauds. The results achieved show the excellence of our professionals in this area. We were able to work on several highly complex cases and achieve the results intended by our clients. Specifically in regard to corruption fighting, Demarest e Almeida was also a pioneer in taking part in the preparation of corruption prevention programs and due diligence procedures under international anticorruption rules, especially the US Foreign Corrupt Practices Act (FCPA).
The activities of our Corporate Criminal Law Department comprise:
• Guidance for, and defense of, our clients in police investigations and/or criminal actions resulting from charges of tax evasion, foreign currency drain, money laundering, occupational accidents, crimes against the environment, crimes against the economic order, crimes against consumer relations, crimes against the honor, crimes of violation of copyrights, and of trademark and patent rights, crimes of unfair competition;
• Guidance for, and defense of, the interests of clients in cases of fraud committed by third parties or employees, adopting the applicable legal measures within the police and/or judicial sphere aiming at the punishment of the defrauders.
• Preparation or adaptation of corruption prevention programs under the FCPA and further international anticorruption rules;
• Guidance and opinion on red flags that should be raised in regard to the engagement of third parties and assignment of due diligence reviews to third parties, or to know-your-client programs.
• Participation in business groups by monitoring corruption prevention programs and giving training on the matter.
