CADE condemns fuel cartel in Rio Grande do Sul State

On June 6th, 2013, eight gas stations and seven individuals were condemned by the Administrative Council for Economic Defense - CADE for cartel practice in the resale of fuel in the municipality of Santa Maria, State of Rio Grande do Sul.

During the instruction of the case, wiretapping were used as important evidences against the defendants, since it remained clear that the gas station owners jointly fixed the gasoline prices, as well as were planning to fix ethanol  prices.

Studies carried out by both the National Agency of Petroleum, Natural Gas and Biofuels - ANP and the Secretariat for Economic Monitoring of the Ministry of Finance - SEAE also gathered relevant information about the economic advantage obtained by the gas stations involved in the cartel, due to the overprice.

The Reporting Commissioner of the case, Ricardo Machado Ruiz, highlighted that although consumers are the main affected parties by the cartel practices, such conducts also impact the economic structure as a whole, alongside with other players in the marketplace.

The fines applied to the condemned parties reach a total amount of R$ 19.000.000, 00 (nineteen million Reais).
