Authorization for Work on Sundays and Holidays

Dear clients,
 
The Ministry of Labor and Employment's Administrative Order no. 945 was published on the Brazilian Federal Register on July 09, 2015. It establishes the new procedures for temporary authorization for work on Sundays and holidays.
 
The main innovation of the Administrative Order is the possibility of obtaining authorization for work on Sundays and holidays under a specific Collective Bargaining Agreement executed between the employer and its employees' union registered with the Ministry of Labor and Employment, without the need to obtain authorization from the competent authority.
 
In these cases, the authorization will be deemed granted only after the Collective Bargaining Agreement is registered with the Ministry of Labor and Employment.
 
In addition to the authorization under a specific Collective Bargaining Agreement, the companies will still be able to ask for the authorization directly to the Ministry of Labor and Employment, should they wish. In such case, the request for authorization to the competent authority now requires that the employer present a notice to the union instead of presenting a Collective Bargaining Agreement.
