ANAC (National Civil Aviation Agency of Brazil) approves proposal of review of the General Conditions of Air Transportation (CGTA)

On December 13, 2016, ANAC approved the Resolution No. 400/2016, which defines the new General Conditions of Air Transportation, consolidating the new rights and obligations of passengers that will come into effect in March, 2017.

Among the main modifications, we emphasize: (i) the end of the mandatory franchise of luggage in national and international flights; (ii) increase of the franchise for hand luggage; (iii) the consolidation of the right to cancellation of the passengers; (iv) decrease of the time for reimbursement in case of cancellation of plane tickets; (v) the obligation to inform the final amount of the plane tickets, already including the fees, in the moment of commercialization; (vi) the prohibition of automatic cancellation of the return flight; (vii)  the regulation of the term for reimbursement and compensation for loss of luggage;  among others.

By means of this review and of the consolidation of the rules, all General Conditions of Air Transportation and the assistance rights guaranteed to all passengers shall be centered in one sole normative document. According to ANAC, the main goal of this change is to perfect the rights of the passengers, making the Brazilian rules compatible to what is practiced in the market and with the international standards, in addition to encouraging the competitiveness among the airline companies and stimulating market growth, which will enable the entry of low cost services companies and the unification of air transport.

ANAC emphasized that the measures approved will be effective for the tickets commercialized as of 03/14/2017, and the airline companies shall be responsible to modify all information contained in their websites, as well as their own transportation agreements.
