Decree Regulates Procedure for Companies Opening, Registration and Amendment
It was published in São Paulo, the Decree No. 57299 of September 8th, 2016, which regulates the electronic procedure, unified and simplified for companies opening, registration and amendment, including: (i) "Feasibility Assessment" ("Consulta de Viabilidade"), (ii) application in the Municipal Enrollment, and (iii) licensing considered low risk ventures through integrator procedures system.
The Decree No. 57299/16 provides that the "Feasibility Assessment" will have information as the official description of the address of its interest and the answer to the consultation for the indicated activity exercise, to show requesting the necessary information and viability for licensing of low-risk ventures. And to ensure the linearity of the process, the registration in the Municipal Enrollment will use the data previously filled by the user.
The related Decree states that may only be collected information and statements directly related to the exercise of the applicant's activity, without the requirement of ownership document or lease agreement, proof of correctness of tax liabilities relating to the property which headquarters, branches or establishment will be installed, and the documents relating to the regularity of the building to be considered low-risk ventures.
The Decree No. 57299/16 shall take effect in 30 (thirty) days from the date of its publication.
