Brazilian Patent and Trademark Office - “BPTO” establishes a pilot project of shared examination in collaboration with the Japan Patent Office - “JPO”

On March 24, 2017, Resolution 184 was published with the purpose of establishing the administrative procedure of the Pilot Project of Shared Examination Patent Prosecution Highway - PPH. One of the main objectives is to reduce the examination load and improve the quality of examination of the main patent offices in the world.

This specific project has been developed in collaboration with the JPO and the BPTO.

Through the PPH, Brazilians will be able to use the result of the Patent Examination that was granted in the BPTO for the acceleration of applications under analysis in Japan and vice versa.

The pilot phase lasts two years and the BPTO will receive up to 200 applications in the PPH. It is important to note that there is a restriction of six patent applications per applicant every four months.

Through PPH, BPTO will only accept patent applications that are explicitly related to the technical field of information technology, extending also to mechanical engineering and automotive technology. Japan will accept requests related to any field.
