Ordinance No. 559, of August 03, 2016 - Secretariat of Labor Inspection
On August 05, 2016, the Federal Gazette published ordinance no. 559, of august 03, 2016 of the Secretariat of Labor Inspection, which provides on the use of SESMT System (SESMT - Specialized Services in Occupational Health and Safety).
The main consequence of said Ordinance is the mandatory use Labor Ministry's SESMT Electronic System to register company's SESMT, replacing than the register made directly in the regional unities of Labor Ministry.
In this sense, companies which already have a SESMT registered at Labor Ministry will have to made the register through the SESMT Electronic System in up to six (6) months (i.e., up to February 05, 2017).
During this same term, companies may also file a solicitation to register their SESMT directly at a Labor Ministry's regional unity together with a justification for not using the SESMT System.
SESMT System shall not be used to register:
(i) SESMT composed by more than thirty (30) establishments.
(ii) "Common SESMT" - companies not required by law to have a SESMT, as provided for in item 4.14 of Regulatory Norm No. 04 ("NR-04").
(iii) SESTR - Specialized Services in Occupational Health and Safety in Rural Work, as provided for in item 31.6 of Regulatory Norm No. 31 ("NR-31").
(iv) SESSTP - Specialized Services in Occupational Health and Safety of Harbor Workers, as provided for in item 29.2.1 of Regulatory Norm No. 31 ("NR-29").
The Specialized Services mentioned above shall continue to be registered at the regional unities of Labor Ministry.
