Food Recall


On 6/2/2015, the Brazilian Health Surveillance Agency (ANVISA - Agência Nacional de Vigilância Sanitária) approved Collegiate Board of Directors' Resolution RDC no. 24, providing for the recall of food not suitable for consumption and the respective manner of communication to ANVISA and consumers in general.
Seeking to improve the sanitary control of food products - in line with the recommendations of the Food and Agriculture Organization (FAO) and the World Health Organization (WHO) - as well to determine producers' liability for the offer of products not suitable for consumption, ANVISA established criteria and procedures it considers appropriate for the recall of food products, including fresh and unprocessed food products, beverages, bottled waters, food ingredients, raw materials and food additives, manufacturing technology additives and other materials in contact with food.
Among the innovations introduced by the Resolution is companies' obligation to have a prior product Recall Plan that is accessible to the employees involved therein and available to the sanitary authority upon request.
Furthermore, and seeking to ensure the effectiveness of the recall, companies are required to have records that may ensure the product traceability in the food supply chain. To that end, they will be required to maintain records allowing the identification of the companies immediately before and after in the chain as well as the products received and distributed.
Finally, in line with the procedures for recall provided for in the consumer laws, the Resolution provides that companies are required to take measures to issue a warning message to consumers, containing concise information and attempting to be as clear and objective as possible, on different communication media.
RDC no. 24 was published in the Federal Official Gazette of 6/9/2015 and will take effect one hundred and eighty days (180) days after its publication.
