Court ruling suspends new criteria to calculate the mandatory contribution to finance the Port Labor Workforce Management Entity of the Organized Port of Santos (OGMO)

In early April 2019, port operators represented by Demarest obtained an injunction suspending the new criteria to calculate the mandatory contribution to finance OGMO.

According to the decision, the new criterion of the cost contribution is illegal and incompatible with the purpose of the OGMO, since it is based on the number of tons handled and not on the number of single port workers requested by Port Operators.

The decision is restricted to the individual case, but can serve as a precedent for other operators affected by the change of criteria.
