State of Mato Grosso do Sul Environmental Protection Agency releases new notice, clarifying obligations related to reverse logistics system

14 de dezembro de 2020

Brazil’s State of Mato Grosso do Sul Environmental Protection Agency (“IMASUL”) issued on December 10, 2020, the 5th Clarification Notice regarding the Registry in the Reverse Logistics System (“SISREV”), in relation to compliance with State Decree No. 15,340/2019. Such Decree obligates manufacturers, importers, distributors and traders of products that generate packaging as residues after consumers use, to structure and implement reverse logistics systems, independent of urban cleaning services and solid waste management in the State of Mato Grosso do Sul.

According to the Notice, the deadline for registering in SISREV, which would end on December 10, 2020, remains open for new registrations. However, operational legal entities of the reverse logistics system have to first register in the IMASUL Registration and Environmental Strategic Information System – SIRIEMA.

Companies that do not intend to constitute new operational legal entities may adhere to the reverse logistics system already on-going and registered in SISREV.

On IMASUL’s website, a list was published indicating the operational legal entities registered in SISREV up to December 10, 2020.

In addition, the deadline to present an Annual Performance Report of goals fulfilled in 2019 to IMASUL, which was initially set for December 10, 2020, was extended to January 31, 2021.

After January 31, 2021, IMASUL will inform to the State of Mato Grosso do Sul Public Prosecutor’s Office the regularized companies.

Demarest’s Environmental Law team is available for any clarifications on this and other related matters.
