ANATEL revises parameters for the collection of economic-financial and technical-operational data

Recently, Brazil’s National Telecommunications Agency (“ANATEL”) published Decision No. 5/2026/CGE, which establishes new parameters for the periodic collection of economic-financial and technical-operational data from telecommunications providers. The recent document repeals Order No. 30/2020/SUE (aimed at small-scale providers – “PPPs”) and Order No. 32/2020/SUE (aimed at large-scale providers, or “non-PPPs”). Additionally, the norm standardizes the information that must be provided by both categories of telecommunications providers.

As reported by ANATEL, Decision No. 5/2026/CGE will take effect on August 01, 2026, at which time companies must comply with the new submission format. Therefore, submissions scheduled for May 2026 will still be subject to the parameters of Orders No. 30 and No. 32, of 2020.

The periodicity  of information submission remains the same. For PPPs, submissions are required biannually and occur on May 31 and August 31. For non-PPPs, submissions will continue to be required quarterly – on May 31, August 31, and November 30.

Below, we list the changes introduced by Decision No. 5/2026/CGE.

 

1) Scope: PPPs operating in personal mobile services and switched fixed telephone services are now required to report data

Decision No. 5/2026/CGE expanded the scope of PPP companies required to report economic-financial and technical-operational information. Previously, PPP providers of Switched Fixed Telephone Services (“STFC”) and Personal Mobile Services (“SMP”) not classified as Virtual Networks were exempt from reporting. However, as of the effective date of Order No. 5/2026/CGE, they will be required to report such data.

2) Increased volume of data required from PPPs and non-PPPs

With the standardization of information in a single order, PPPs will now report the same volume of information as non-PPPs, as shown below. For non-PPPs, the change lies in the increased volume of information regarding the Net Operating Revenue (“ROL”), Traffic, and Capital Expenditure (“CAPEX”), which also requires information related to Value-Added Services (“SVA”).
