ANATEL submits proposed 2027–2028 Regulatory Agenda for public consultation

The National Telecommunications Agency (“ANATEL”) has published Public Consultation No. 25/2026, aimed at gathering contributions on the proposed 2027–2028 Regulatory Agenda. The proposal comprises 32 regulatory initiatives, 6 of which are new projects, highlighted below. Additionally, the proposal includes 6 Regulatory Outcome Evaluations (“ARR”) – 2 continuing from the previous agenda and 4 new. In total, 13 initiatives are classified as priorities.
The 32 initiatives are organized by themes and subthemes, as described below:
Provision of Telecommunications Services
- Cybersecurity – review of the Cybersecurity Regulation to address artificial intelligence, network vulnerabilities, cloud computing and sector-related data centers (priority).
- Artificial Intelligence – reassessment of regulation in light of the use of AI across the entire service provision chain, focusing on ethical use and recommendations from UNESCO and the International Telecommunication Union – ITU (priority).
- User Duties – issues related to traffic generated by OTT services and the provision of Value-Added Services (VAS) bundled with telecommunications service plans (priority).
- Submarine Cables – consolidation and update of rules, including physical and cybersecurity requirements.
- Network Sharing and Roaming in the Personal Mobile Service (“SMP”) – focus on highway coverage and compliance with commitments undertaken by operators through tender processes.
- Future of the Switched Fixed Telephone Service – “STFC” (new topic) – reassessment of the STFC framework and economic regulation instruments (including the Telecommunications Services Index – “IST”), in light of the termination of concessions.
- General Accessibility Regulation (“RGA”) – reassessment of the RGA (Resolution No. 667/2016) to include persons with disabilities and propose improvements to the Centro de Integração da Cidadania – CID (priority).
- Tenders – tender notices for the 850 MHz and 6425–7125 MHz frequency bands (priority).
Infrastructure and Spectrum
- Pole Sharing – reassessment of Joint Resolution ANATEL/ANEEL No. 4/2014 (priority).
- Spectrum Caps – reassessment of radiofrequency spectrum caps held by each operator – Resolution No. 703/2018 (priority).
- Radiofrequency Spectrum Use Regulation (“RUE”) – review of the RUE; Resolution No. 671/2016 (priority).
- Allocation, Designation and Distribution Plan for Frequency Bands in Brazil (“PDFF”) (new topic) – update of the 2025–2026 PDFF for the 2027–2028 period.
- Restricted Radiation – review of the Regulation on Restricted Radiation Equipment and the relevant frequency bands (Resolution No. 680/2017).
Satellites
- Satellites – assessment and proposal of sustainability rules for the use of orbital resources.
Quality
- Quality of Service Regulation (“RQUAL”) – reassessment of the RQUAL (Resolution No. 717/2019).
- Satisfaction survey (new topic) – reassessment of regulation on Satisfaction Surveys and Perceived Quality (Resolution No. 654/2015).
Authorization and Service Provision
- Competition and Fixed Broadband – adjustments to authorization rules aimed at combating unfair competition and regularizing fixed broadband services (priority).
- General Licensing Regulation (“RGL”) – review of the RGL to align with Precedent No. 28/2025.
- Conditional Access Service (“SeAC”) – reassessment of SeAC obligations, including the evaluation of regulatory costs associated with such obligations (priority).
Network Remuneration, Finance, and Revenue Collection
- Simplification and consolidation of rules on network usage remuneration, with extension to the Multimedia Communication Service (“SCM”).
- Review of the Regulation on Revenue Refund and Set-Off (priority).
- Review of the regulation governing installment payment of non-tax credits (new topic).
Simplification and Governance
- Regulatory guillotine initiative for 2027–2028 (new topic).
- Review of ANATEL’s Internal Rules (priority) and creation of new internal committees.
- Incorporation and consolidation of rules and resolutions issued by international organizations (new topic).
- Regulatory Outcome Evaluations (ARR – Annex II) – General Interconnection Regulation – RGI (Resolution No. 693/2018), General Licensing Regulation – RGL (Resolution No. 719/2020), General Authorization Regulation – RGO (Resolution No. 720/2020), Regulation on the Measurement of Customer Satisfaction and Perceived Quality (Resolution No. 654/2015), Regulation on the Use of Telecommunications Services in Disasters, Emergency Situations and States of Public Calamity (Resolution No. 739/2020), and Cybersecurity Regulation (Resolution No. 740/2020).
The consultation will be open for contributions on the Participa Anatel platform until August 3, 2026. The related documents are available on ANATEL’s Electronic Information System (SEI).
