Call for Contributions No. 1/2026: Anatel starts the collection of contributions on users’ duties regulation and the marketing of Value‑Added Services

Anatel opened Call for Contributions No. 1/2026 to obtain contributions on over‑the‑top (OTT) service traffic and to assess the structures for the marketing, sign‑up, billing, and cancellation of Value‑Added Services (VAS).

The measure was proposed by Counselor Edson de Holanda, the rapporteur for the public consultation on the proposal of the new Regulation on the Duties of Telecommunications Services Users. The collected data will subsidize a potential revision of this normative proposal as well as the drafting of a best‑practices guide for transparent digital offers within Anatel’s consumer protection and digital trust agenda. The initiative is part of item 9 of the current 2025–2026 Regulatory Agenda.

The questionnaire contains 18 questions designed to elucidate Brazil’s digital ecosystem, structured around the following topics:

  • Data traffic volumes, impacts on investment, and effects on service quality and user experience.
  • Transparency and clarity of VAS contracting conditions, including pricing.
  • Existence of informed and granular consent for VAS subscription.
  • Methods for cancelling VAS without affecting the main service.
  • VAS billing models.
  • Joint liability between telecom operators and VAS providers.
  • Processing of personal data associated with VAS activation and use.
  • Potential darkpattern practices (behavioral nudges or digital barriers).

In addition to the structured questions, Anatel provides a free space for additional comments, ensuring that topics not yet covered are included.

Call for Contributions No. 1/2026 will remain open for contributions on the Participa Anatel platform until June 25, 2026. The associated documents are available for consultation in Anatel’s Electronic Information System (SEI).
