The Evolving Mining Legal Framework (Lex Mineralia) Shaped by International Arbitration and Its Role on the Governance of Critical Minerals
August 20th, 2025
The growing demand for critical minerals, essential for the energy transition and for green technologies such as electric vehicles and energy storage systems, has placed the mining sector at the center of a challenging geopolitical landscape.
In the article “The Evolving Mining Legal Framework (Lex Mineralia) Shaped by International Arbitration and Its Role on the Governance of Critical Minerals”, originally published by The Foundation for Natural Resources and Energy Law in the manual of the Special Institute on International Mining and Energy Law, Development, and Investment, our partner @Tiago de Mattos, in co-authorship with @Daniela Vergel, @Mayra Bryce Alberti, and @Alfonso Rebaza, analyzes how international arbitral jurisprudence has been shaping a transnational mining legal order and the role of this evolution in the governance of critical minerals.
The piece also discusses the importance of stable, consistent, and investor-friendly regulatory frameworks, particularly in a global context of mounting pressure for legal certainty and sustainability in mining.
