Partner in Demarest’s Dispute Resolution practice area, Ana Damasceno holds a Ph.D. in Civil Procedural Law from Universidade Federal de Minas Gerais (UFMG), a Master of Laws (LL.M.) from Universidade Federal de Ouro Preto (UFOP), and a Bachelor of Laws (LL.B.) from Universidade Federal de Minas Gerais (UFMG). She also holds a postgraduate degree in Public Law from Pontifícia Universidade Católica de Minas Gerais (PUC-Minas). Among her main clients arecompanies operating in the mining, steel, metallurgy, energy, agribusiness, and forestry sectors. She serves as a professor in postgraduate programs at PUC-Minas and at Centro de Estudos em Direito e Negócios (CEDIN). Ana has extensive experience in civil litigation and in real estate matters, not only from a judicial standpoint but also in related administrative and advisory proceedings.

  • Advised a prominent iron ore producer on the execution of an inter-institutional settlement agreement within the context of a public-interest civil action concerning the resettlement of communities located in the vicinity of a mining project, involving amounts exceeding BRL 100 million.
  • Advised a leading trade association representing the mining sector in a class action challenging the constitutionality of an infra-legal regulation governing tailings and waste rock, the enforcement of which directly and materially impacts companies operating in the sector.
  • Advised a prominent iron ore producer of significant economic and operational significance in the Northeast region of Brazil in judicial disputes over mining rights and operational areas for production outflow, resulting in the recovery of at least BRL 93 million in financial liabilities.
  • Advised a major iron ore producer in obtaining a declaration of public utility to enable the expansion of its mining project, as well as in the subsequent litigation phase concerning access to the relevant areas.
  • Advises a leading trade association representing the mining sector in public-interest civil actions addressing the mandatory enforcement of an international standard as a condition for issuing mining authorizations in regions occupied by traditional or quilombola communities.
