Public Consultation period on the Revision of the National Policy on Climate Change will end on December 1

The deadline for contributing to the public consultation on the draft bill proposing the revision of the National Policy on Climate Change (“PNMC”) will end on December 1, 2025.

The Executive Secretariat of the Interministerial Committee on Climate Change invited the public, researchers, public managers, and other interested parties to participate in the consultation through the “Brasil Participativo” platform.

The revision of the PNMC aims to update the legal instruments, goals, and guidelines focused on addressing the climate emergency, promoting public policies that include mitigation, adaptation, and social justice.

Established by Federal Law No. 12.187/2009, the PNMC establishes principles such as precaution, prevention, citizen participation, sustainable development, and common but differentiated responsibilities. Among its objectives are:

  • to reconcile socio-economic development with the protection of the climate system;
  • Reduce anthropogenic greenhouse gas emissions;
  • Strengthen carbon sinks;
  • Promote adaptation to climate change at all three Federal levels;
  • Preserve and restore environmental resources, with attention to major national biomes; and
  • Stimulate the development of the Brazilian Emissions Reduction Market (MBRE) and the Brazilian Emissions Trading System (SBCE).

The PNMC also defines guidelines aligned with international commitments undertaken by Brazil, such as the United Nations Framework Convention on Climate Change. In addition to defining guidelines, it provides for instruments such as the National Climate Change Plan, the National Climate Change Fund, and Action Plans for the Prevention and Control of Deforestation.

Active participation in this consultation aims to ensure that the new version of the PNMC reflects the needs and priorities of Brazilian society, strengthening the implementation of public policies in the face of climate change.

The government and the Legislative Branch have demonstrated openness to receiving contributions from stakeholders when drafting regulations that may impact their activities.

As in the case of the PNMC, we were able to identify opportunities for clients to participate in public decision-making processes and assist them in presenting regulatory proposals to public authorities to improve the efficiency of regulation implementation and promote a healthier and more competitive business environment.
