This information channel is the result of the collaboration between our “Oil & Gas” and “Energy” teams.

The newsletter was designed within the context of the energy transition that is being targeted in Brazil, and drafted as a complete source of information about the dynamic Brazilian energy market within the oil, natural gas, electricity and renewable energy sectors.

HIGHLIGHTS

Brazil sets record for oil and natural gas production in September

On November 01, 2023, the Brazilian National Agency for Petroleum, Natural Gas and Biofuels (“ANP”) released the Monthly Oil & Gas Newsletter for September 2023, which gathers consolidated data regarding Brazil’s production. September 2023 set a record in the overall production (oil + natural gas), as well as in oil and natural gas separately, and also in the pre-salt production area.

As reported by the ANP, 4.666 million barrels of oil equivalent per day (MMboe/d) were produced, which is considered the largest total production ever recorded, exceeding the record of July 2023 (of 4.482 million MMboe/d). Particularly with regard to oil, 3.672 million barrels per day (Mmbbl/d) were produced, representing a 6.1% increase in relation to the previous month, and 16.7% if compared to September 2022. The previous largest production recorded was 3.513 Mmbbl/d, for July 2023.

The natural gas production in September was 157.99 million cubic meters per day (MMm³/d), a 6.9% increase in relation to the previous month, and 10.4% as compared to September 2022. Also, it was the largest volume recorded to date, exceeding the one registered in July 2023, amounting to 154.076 million cubic meters per day (MMm³/d).

RenovaBio: ANP releases 2023 updated goals for distributors

On November 03, 2023, the ANP published, in the Federal Official Gazette of Brazil, the order containing the 2023 updated individual mandatory goals to be met by fuel distributors, under the Brazilian National Biofuels Policy (“RenovaBio”). The individual goals for 2023 were published in the beginning of this year, but were updated to include the unmet 2022 goals, as determined by the current legislation.

The ANP calculates individual goals based on the annual mandatory goal defined by the Brazilian National Council for Energy Policy (“CNPE”). The market share of each fuel distributor in the trading activity of fossil fuels is calculated according to the methodology described in article 6 of ANP Resolution No. 791/2019.

The goals are met by fuel distributors by removing decarbonization credits (“CBIOs”) from circulation in an amount that corresponds to their goals. The deadline for proving compliance with the 2023 goals is closed, and the ANP published the results on October 19, 2023. For distributors that did not fully meet their 2022 goals, the amount of CBIOs not yet removed from circulation were added to the 2023 goals. According to Decree No. 9,888/2019, the deadline for proving compliance with the 2023 goals will be closed on March 31, 2024.

Natural gas: ANP approves simplified procedures for contracting gas pipeline transport services

On November 23, 2023, the ANP’s board of directors approved ANP Resolution No. 961/2023, which resulted in specific changes to ANP Resolutions No. 51/2013 and No. 11/2016, that regulate, respectively, the process of offering and contracting transport capacity as well as the activity of shipping of natural gas. As informed by the ANP, the purpose of these changes is to adapt the regulations to the New Gas Law (Law No. 14,134/2021) and simplify procedures. Improvements were made to the process of offering and contracting capacity in existing gas pipelines, as well as to the public call procedure for estimating demands and contracting capacity in transportation pipelines to be further built or expanded.

Among the changes made, it is worth highlighting:

the use of a master contract that advances the registration and qualification steps, including the regulation of the offering process;
the approval of the contractual draft by the ANP, as carried out in the contracting of short-term and interruptible transport services; and
the public tariff consultation, in the process of offering and contracting capacity, in the year prior to the beginning of the regulatory cycle, or at any time, at the discretion of the ANP, and in the public call process.

Public data on mature marine fields can be requested free of charge

On November 09, 2023, the ANP’s board approved the provision, free of charge, of pre-stack data from public 2D and 3D seismic surveys located in offshore areas where mature fields are located.

As a result, any individual or legal entity, whether domestic or international, will be able to access such public data, which are stored in the Exploration and Production Database (“BDEP”).

The agency emphasized that providing the data free of charge is in line with the guidelines of CNPE Resolutions No. 17/2017 and No. 10/2020, which are:

encouraging and proposing measures to stimulate the use and production of oil and natural gas in marine basins;
development of small and medium-sized oil findings;
increased participation of small and medium-sized companies;
fostering revitalization and increasing the recovery factor of these mature fields; and
fomenting research and development through universities and research centers.

Those entities that obtain pre-stack data will be in charge of processing them in compliance with the standards established by the ANP, as well as of reporting the results obtained to the ANP within a maximum period of 12 months, further enriching the Brazilian technical data archives.

ANP regulates the import of biodiesel

On November 23, 2023, the ANP’s board approved the draft resolution regulating the import of biodiesel for use in the mandatory blend with diesel oil of fossil origin, thus amending ANP Resolutions No. 777/2019, No. 857/2021, and No. 959/2023.

Currently, in Brazil, biodiesel is used in the mandatory blend with diesel oil in a proportion of 12%, in addition to other experimental uses and for private consumption (for the latter two, importing was previously authorized). The approved resolution establishes that the imported volume of biodiesel, by each fuel distributor, will be limited to 20% the overall volume for mandatory blending. This is because ANP Resolution No. 857/2021 determines that distributors must submit a monthly proof of their biodiesel acquisition from a producer holding the Social Biofuel Seal (Selo Biocombustível Social), in a minimum share of 80%.

It is worth mentioning that this ANP measure observes the guidelines of the CNPE, which established that the ANP must regulate the import of this product in compliance with CNPE Resolution No. 14/2020.

ANP determines that onshore oil and gas field operators must carry out self-diagnosis

On November 23, 2023, the ANP board approved a measure establishing that onshore oil and gas field operators must carry out a self-diagnosis in relation to the operational safety of their facilities.

As informed by the ANP, this measure, which must be followed by operators holding obligations before the Structural Integrity Management (“SGI”) or the Operational Security Management System (“SGSO”), is part of the measures taken by the ANP to strengthen the safety of exploration and production operations so that the industry grows and develops safely.

The guidelines for self-diagnosis and the information that must be provided by companies will be listed in a technical note yet to be published by the ANP. Companies will have 90 days to carry out the self-diagnosis, as of the notification receipt sent by the ANP.

ANP to initiate study for future regulation on carbon capture, use, and storage

On November 23, 2023, the ANP’s board approved the development of a regulatory study aimed at the insertion of carbon capture, use, and storage (or stockpiling) activities (“CCUS”) in the oil, natural gas and biofuels chain.

As this is a cross-cutting theme, the study will map the ANP’s technical and regulatory areas involved, thus identifying the need for changes and the drafting of new provisions. The ANP reported that the deadline for completion of the study is 120 days.

ANP holds public consultation on inclusion of fuel dye in marine diesel oil

On November 29, 2023, the ANP carried out a public hearing on the revision of ANP Resolution No. 903/2022, which provides for the specifications of fuels for waterway use and their respective trading regulations. The proposed amendment seeks to include the mandatory addition of a fuel dye to marine diesel oil.

The agency emphasized that the aim of the proposal is to visually differentiate marine diesel oil from S10 road diesel oil, thus curbing potential irregular trading activities involving this product. The intention is to prevent marine fuel from being traded as road fuel, since it has a lower price, which could encourage economic agents to obtain undue financial advantages.

Contributions received by the ANP through the public consultation and hearing will be assessed by the technical area so as to amend – or not – the original draft proposed. Before publication, the consolidated text will undergo the legal analysis of the Brazilian Federal Public Prosecutor’s Office (“PGF”) in collaboration with the ANP, as well as the approval of the ANP’s collegiate board.

RenovaBio: CBIO platform now features a module on long-term contracts

On November 29, 2023, the ANP announced a module on long-term contracts on the CBIO Platform, a new feature for registering contracts for the acquisition of biofuels signed between biofuel distributors and producers (or cooperative of producers), as well as for monitoring contracts for the purpose of reducing the individual goals of fuel distributors.

This matter is provided for in Articles 6-A, 6-B, and 13-A of ANP Resolution No. 791/2019, with additional wording provided for in ANP Resolution No. 921/2023, aimed at reducing the annual mandatory goals of fuel distributors by means of long-term contracting with biofuels producers certified by the RenovaBio program, under art. 2 of CNPE Resolution No. 8, of 2020.

Contracts signed prior to the operation of this module must be registered by December 29, 2023, as provided for in article 6-B of ANP Resolution No. 791/2019.

ANEEL publishes tender notice for second 2023 transmission auction and approves draft for 2024 round

On November 09, 2023, the tender notice for the second 2023 transmission auction (Auction 02/2023), to be held by the Brazilian National Electricity Regulatory Agency (“ANEEL”), was published aimed at granting a 30-year concession for the public energy transmission service.

The auction will involve 3 lots of transmission facilities, totaling 3,000 kilometers of transmission lines and sectionings, as well as 9,840 MW in transformation capacity for substations located in the states of Piauí, Goiás, Maranhão, Minas Gerais, São Paulo, and Tocantins. Auction 02/2023, whose public session will take place on December 15, 2023, is expected to generate 36,900 thousand jobs, and raise approximately BRL 21.7 billion in investments.

It is worth highlighting that on November 21, 2023, the board of directors of ANEEL approved the draft tender notice for Transmission Auction No. 01/2024, which will place 15 lots of transmission facilities up for contract, amounting to 6,464 kilometers of new transmission lines and sectionings, as well as 9,200 MW of transformation capacity. The auction is expected to take place on March 28, 2024, and generate 34,000 jobs. In addition, it is expected to raise approximately BRL 18.2 billion in investments.

MME initiates public consultation to optimize thermoelectric generation

On November 13, 2023, the Ministry of Mines and Energy (“MME”) initiated Public Consultation No. 158/2023, aimed at obtaining contributions on a proposed ordinance allowing a reduction in the inflexibility of thermoelectric power plants that hold Regulated Electric Energy Trading Contracts (“CCEARs”), in order to reduce costs of the Regulated Contracting Environment (“ACR”) and enhance operational flexibility in the event of energy surplus in the National Interconnected System (“SIN”).

According to the MME, “the key idea is to reconcile systemic and sector agents’ interests, as well as prevent thermoelectric power plants from presenting inflexible generation for contractual reasons at times when the electrical system is sufficiently supplied by other less costly sources.”

Regulation published on transfer of corporate control as an alternative to concession extinction

On November 24, 2023, ANEEL Normative Resolution (“REN”) No. 1077/2023 was published, which established the guidelines for the approval of transfer of corporate control involving the concession, permission or authorization of services and facilities for electricity generation and transmission, whose project is under implementation or expansion, as an alternative to the extinction of the concession.

The plan for transfer of corporate control must demonstrate the feasibility of the transfer of control as well as the benefits of this measure for the adequate rendering of the service and for the termination of the concession.

ANEEL initiates call for contributions to mitigate energy trading mechanisms within the SCEE

On November 03, 2023, ANEEL initiated Call for Contributions 018/2023 (“TS”) to evaluate specific regulatory commands regarding art. 28 of Law No. 14,300/2022 (which establishes that “distributed microgeneration and minigeneration are characterized as the production of electricity for self-consumption”), as well as to mitigate energy trading within the Electricity Offset System (“SCEE”).

Technical Note No. 101/2023-STD/ANEEL, which is part of this TS, clarifies that the numerous commercial arrangements that can be framed as remote generation must comply with the regulation prohibiting power trading , “even if implicitly, of credits and surplus energy from distributed generation, but also benefits from the assignment of credits and surplus energy to other holders”.

In this TS, interested parties will be required to respond to questions such as: “What market situations can be framed as power trading within the SCEE? What elements could characterize or serve as evidence for power trading within the SCEE?”, among others.

Representatives of Latin American countries execute agreements during the Energy Week

During the second week of November 2023, the eighth edition of the Energy Week took place in Montevideo, Uruguay. The MME attended the event through MME’s National Secretary for Energy Transition and Planning (“SNTEP/MME”).

Throughout the meeting, representatives of Latin American countries signed major agreements, such as the agreement on the creation of a gender commission for the Latin American Energy Organization (OLADE). This commission is aimed at enforcing gender equality in the sector’s opportunities, as well as creating a working group to develop the opportunities for gas integration and another one to study low-carbon fuels across this region.

Brazil is now a member of the World Energy Council

On November 14, 2023, the World Energy Council (WEC) announced Brazil’s integration into its framework of members. Brazil’s integration into the WEC will allow the country to take part in crucial discussions on the energy sector.

ONS calls for proposals on Demand Response Structural Program

Due to the above-average temperatures across most of Brazil, the Brazilian National Electric System Operator (“ONS”) has announced that it is currently collecting proposals for the Demand Response Structural Program, established by REN No. 1040/2022, as an excellent resource for meeting SIN’s peak load, thus contributing to operational safety in a sustainable manner and at reduced costs.

The program is aimed at collecting offers to reduce consumption from consumers participating in the Free Contracting Environment (“ACL”) who have previously qualified and registered with both the Electric Energy Trading Chamber (“CCEE”) and the ONS. These consumers must submit their proposals on a weekly basis. The minimum lots of the products on offer will be of 5 MW, per sub-market, with time periods ranging from 4 to 17 hours, and a standard volume of 1 MW.

SIN and PLD calculation mechanisms changed

On November 24, 2023, Order No. 4,539/2023 was published, which authorized the use of version 20 of the computational model called Short-Term Hydrothermal Dispatch Model (“DESSEM”), for the purposes of daily programming SIN’s electric energy operation as well as the Differences Settlement Price (“PLD”). As for SIN’s planning and operation – and for PLD formation –, version 29 of the computational model called “Newave” is expected to be used on the basis of the Monthly Operating Program (“PMO”). Both computational models should be used as of January 2024.

HIGHLIGHTS

MME submits proposal for Hydrogen Bill to CDESS

On November 07, 2023, the Ministry of Mines and Energy (“MME”) submitted to the Energy Transition Working Group of the Sustainable Social Economic Council (“CDESS”) (a.k.a.“the Big Council”) the proposed Bill for the legal framework for hydrogen in Brazil, seeking to regulate the certification of this product, as well as to encourage the development of the hydrogen economy within the country. The proposal was drafted by the Steering Committee of the National Hydrogen Program (“COGES-PNH2”), which gathers representatives of numerous governmental bodies and entities connected with this topic.

The Hydrogen Bill creates the Brazilian Hydrogen Certification System (“SBCH2”) and defines its structure, governance, and competences. In addition, this bill establishes guidelines for exploration and production of natural hydrogen within Brazil. The legal framework for hydrogen is one of the priorities of the PNH2 Three-year (2023-2025) Work Plan.

It is worth emphasizing that the MME’s proposal is not to be mistaken for PL No. 2308/23, approved by the House of Representatives on November 28, 2023, which proceeded to the Brazilian Federal Senate for further analysis.

European Union announces construction of a green hydrogen power plant in Brazil

On November 20, 2023, the European Union announced the construction of a green hydrogen power plant in Brazil. According to this publication, the power plant will be built on the coast of Piauí, in the Parnaíba Export Zone (“ZPE”) of Parnaíba. The announcement is part of the expansion of the PNH2 projects, coordinated by the MME.

The project will be one of the largest in the world involving green hydrogen, and will feature a production capacity of 10 gigawatts of clean hydrogen and ammonia.

According to the data provided by the MME, Brazil can produce 1.8 gigatons of low-carbon hydrogen per year. In addition, the current projections place Brazil as the least costly country to produce low-emission hydrogen and derivatives. Brazil already benefits from approximately USD 30 billion in announced low-carbon hydrogen projects, thus generating millions of jobs.

The construction works for the new power plant are expected to start at the end of 2024 by the European company Green Energy Park (GEP). Operation start is planned for 2026. This power plant is expected to use the structure of the Luís Correia Port to export hydrogen.

House of Representatives Commission approves draft bill on Hydrogen Legal Framework

On November 28, 2023, the Special Commission on Energy Transition of the House of Representatives approved Draft Bill No. 2,308/2023, whose aim is to establish the Low-Carbon Hydrogen Legal Framework.

Some of the highlights of this project are listed as follows:

SBCH2: creation of the Brazilian Hydrogen Certification System (SBCH2), which will certify the level of greenhouse gas emissions by agents;
ANP Competence: the loading, processing, treating, importing, exporting, storing, stocking, packaging, transporting, transferring, reselling, and trading activities will be regulated by the Brazilian National Agency for Petroleum, Natural Gas and Biofuels (“ANP”) and developed by means of the authorization grant provided by the ANP;
PNH2: establishes competencies for the National Hydrogen Program (PNH2);
REHIDRO: creation of the Special Tax Incentive Regime for Low-Carbon Hydrogen (REHIDRO), which allows the granting of tax benefits in the production of low-carbon hydrogen, such as exemption from the Social Integration Program (“PIS”) and the Contribution for the Financing of Social Security (“COFINS”), as well as the issuance of incentivized debentures; and
PHBC: creation of the Low-Carbon Hydrogen Development Program (“PHBC”), of both accounting and financial nature, serving as a source of funds for energy transition, including through economic subsidies for the commercialization of hydrogen.

After approval by the House of Representatives, the bill will move forward in order to seek approval by the Federal Senate.

MME and JBIC discuss mining, green hydrogen, biogas, and renewable energy during meeting

On November 13, 2023, the MME held a meeting with Japan Bank for International Cooperation (“JBIC”) to discuss the collaboration between Brazil and Japan in the mining, biofuels, hydrogen, and renewable energy sectors. The deputy executive secretary of the MME, Fernando Colli, highlighted that technical cooperation with Japan reinforces the mission towards developing the energy and mineral sectors in Brazil in a safe, sustainable, fair, and inclusive manner. The meeting covered topics such as the plans for the development of mineral resources, as well as the expectations for the Japan-Brazil cooperation in the energy sector, especially as regards renewable energy, biofuels, and hydrogen.

Ichiro Oishi, JBIC’s senior executive officer of the Americas, emphasized the importance of Brazil for the energy transition landscape considering the country’s large mineral reserve – particularly of strategic elements –, as well as its wide variety of renewable energy sources.

Norway and Brazil uphold partnership towards energy transition

On November 07, 2023, a meeting was held between the Financing Agency for Studies and Projects (“FINEP”) and the Research Council of Norway (RCN), through which both parties reiterated their partnership and confirmed the “4th FINEP and Norwegian Council Public Call”, aimed at fomenting innovation in both countries, especially towards energy transition.

Through this public call, FINEP will invest funds from the National Fund for Scientific and Technological Development (“FNDCT”) amounting to BRL 15 million, whereas the National Council for Scientific and Technological Development (“CNPq”) will invest BRL 3 million in scholarships. In turn, Norway will invest BRL 30 million Norwegian crowns in this initiative.

First renewable hydrogen certifications are issued by CCEE

On November 16, 2023, the CCEE published a note on Brazil’s first renewable hydrogen certifications. This certification testifies to the origin of the energy generated from low-carbon sources in projects piloted in Brazil. The certification under discussion was granted to companies EDP and Furnas, and attests to the energy inputs produced from renewable sources.

Furnas produced 730 kg of hydrogen from solar and hydraulic energy, whereas 295 kg of hydrogen were produced by EDP from solar energy.

The hydrogen certification issued by the CCEE attests to the origin of the energy produced from low-carbon sources in projects piloted in Brazil.

MME publishes report on “Recovery Plan for Regularization Reservoirs of Hydroelectric Power Plants in Brazil”

On November 21, 2023, the MME published the “Report on structuring actions and definitions of global indicators”, which integrates the Recovery Plan for Regularization Reservoirs of Hydroelectric Power Plants in Brazil (“PRR”), resulting from the contributions obtained from Public Consultation No. 150/2023. The report outlines 31 actions to be carried out to improve the physical and operational aspects of the reservoirs, as well as SIN’s planning, expansion, and mathematical modeling.

European Union announces construction of a green hydrogen power plant in Brazil

On November 20, 2023, the European Union (“EU”) announced the construction of a green hydrogen and ammonia plant on the coast of Piauí – one of the largest projects of this kind in the world. According to the publication, construction is expected to start at the end of 2024, with operations due to begin in 2026. The local seaport can be used to export the hydrogen produced.

According to information from the MME, this project will be one of the largest in the world involving green hydrogen and “is part of a global investment of two billion euros in the hydrogen chain in Brazil. The new green energy park will rely on a production facility of 10 gigawatts of clean hydrogen and ammonia,” highlighted Ursula von der Leyen, president of the European Commission, in an announcement alongside President Luiz Inácio Lula da Silva.
