Salary Transparency and Remuneration Criteria Report is published early

The Ministry of Labor and Employment (“MTE”) published, today, the “Salary Transparency and Remuneration Criteria Report” through the MTE’s platform.

The platform is quite unstable, and several companies are reporting difficulty accessing its webpage. Due to the format provided, access to the reports is broad and the free research is made using only the corporate taxpayer number (CNPJ), without restricted access through the login in the “gov.br” system.

As previously announced by the MTE, companies must publish the report on their websites and social networks by the end of March 2024.

However, the release of the report has been the subject of controversy, including from the perspective of competition rules violation. This has been provided for in Technical Note No. 3/2024/DEE/CADE, which has recently run in the press, and several actions have already been filed in this regard to contest the need to publish the report.

Given this scenario, we caution our clients regarding the publication of the report.
