eBOOK | New policy for critical and strategic minerals: What changes in the taxation of the sector?

The enactment of Law No. 15,506/2026 marks a new phase for Brazil’s critical and strategic minerals value chain. In addition to establishing the National Policy on Critical and Strategic Minerals (PNMCE), the law creates mechanisms to strengthen mineral processing, transformation, and industrialization.
From a tax perspective, the main highlight is the creation of the Federal Program for the Processing and Transformation of Critical and Strategic Minerals (PFMCE), which provides for a tax credit of up to 20% of eligible expenditures. The legislation also expands access to the Special Tax Incentive Regime for Infrastructure Development (REIDI) for mineral projects, extends the benefits related to incentivized and infrastructure debentures, and establishes exemption from Corporate Income Tax (IRPJ) and the Social Contribution on Net Income (CSLL) for certain funds established under the policy.
Although the law represents a significant step forward in attracting investment, a substantial portion of these incentives still depends on regulation, particularly regarding eligibility criteria, qualification processes, the use of credits, and the implementation of benefits.
